By submittal of art to be represented in the VisionServer Gallery artist agree to the following terms, and also agrees to Portfolio and Resource Terms:
Artists represented in the VisionServer Gallery (VS Gallery) are responsible for keeping
their portfolios current. When art is sold the artist is responsible for taking the art out of their portfolio. If it is a print that sells the inventory within the VS Gallery will be adjusted automatically.
When art is sold, the payment has been completed, and the funds have been added successfully to our account VisionServer will contact artists with shipping information. Artist are responsible for properly packaging and having their art shipped to buyers within three (3) days (not counting delivery time) of purchase unless other shipping arrangements have been specified. All art must be insured throught shipping agent for the purchase price of the art.
Artist agree that VisionServer will hold all funds from the sale of art untill the Gurantee
Period has been satisfied after art has been received by said buyer. When art has been
received and accepted by the buyer the purchase price of the art, along with shipping
charges, less agreed upon commission will be available for the artist to withdraw from
their accounts. We will have the right to make all payments to you by depositing them into the PayPal account that we have on file. We have the right to refuse to issue you a check or credit your credit card, and to use such a deposit as our sole means of payment to you.
In using VisionServer to sell your art and/or prints, you will be the seller; VisionServer is not the seller nor are we the buyer. We are only providing certain services related to your sale. You represent and warrant that you are the rightful owner of each work of art posted for sale on your Portfolio Pages, that no such art is subject to any liens, claims or other encumbrances, and that you are the authorized artist, agent, performer, sponsor or promoter representing the art for which you are posting on VisionServer. You agree not to use VisionServer for any illegal or fraudulent purpose, or to post or sell any art that you do not own and not to impersonate any person or entity, including without limitation,any artist.
VisionServer offers the following gurantee:
If for any reason the buyer decides not to keep a painting, the buyer has seven (7) days - from the day they receive the art/product - to contact VisionServer. The buyer will be reimbursed for the full value of the art/product(s) minus the shipping and PayPal charges.
Buyer is responsible for properly packaging and insuring the art for the purchase price
through shipping agent for safe return of the art to the artist. All packages must be shipped REQUIRING a conformation signature. In the event that art is damaged, purchase price will be retained by the artist.
In the occation that art is returned, artist are responsible for accepting the returned art unless art is damaged. Damaged art must be reported to shipping agent and VisionServer immediately for insurance purposes.
VisionServer will not be responsible for damage caused during shipping. ALL ART MUST BE INSURED for the purchase price during shipping to and from the artist and buyer. All packages must be shipped REQUIRING a conformation signature.
If art is damaged and the art was not insured the party shipping said art is accountable for damages. In the event of any legal actions due to shipping, the responsible party's will consist of artist, buyer and shipping agent only. |
